Botswana’s marriage-equality case has moved to its next stage. The High Court has admitted LGBTQ+ rights group LEGABIBO as the third applicant in the constitutional challenge brought by Bonolo Selelo and Tsholofelo Kumile. Three organisations opposing the challenge were admitted as respondents, while Dr Onthatile Olerile Moeti was admitted as amicus curiae. The main arguments are set for 22–23 October 2026. Why this matters: the case asks whether Botswana’s Marriage Act unlawfully excludes same-sex couples from civil marriage. If the challenge succeeds, Botswana could become the second African country after South Africa to recognise same-sex marriage.
