# Infogaytion Tickets – Ticket Buyer Terms

These Ticket Buyer Terms ("Terms") govern your use of Infogaytion Tickets when you register for, purchase or hold a ticket to an event listed on the platform. They apply to every buyer, attendee and registrant, whether the ticket is paid or a free RSVP.
Infogaytion Tickets is operated by Infogaytion (Pty) Ltd ("Infogaytion", "we", "our" or "us"). Infogaytion™ is a trade mark pending.
By purchasing a ticket, completing a free registration, or attending an event booked through Infogaytion Tickets, you agree to these Terms together with the Infogaytion **Terms & Conditions** and **Privacy Policy**. These Terms complement the **Infogaytion Tickets Refund Policy**, which is incorporated by reference for refund matters.
## 1. Definitions
- **Attendee** means the person who holds and presents a ticket at an event, whether or not they are the original buyer.
- **Booking Fee** means the per-ticket fee charged by Infogaytion and payable by the buyer in addition to the ticket price, as published from time to time.
- **Buyer** means the person who purchases a ticket or completes a free registration through Infogaytion Tickets.
- **Event** means any activity, experience or gathering listed for ticketing or registration through Infogaytion Tickets.
- **Infogaytion Tickets** or **Platform** means the ticketing service operated by Infogaytion, including the Infogaytion websites, applications and related services.
- **Organiser** means the individual or organisation responsible for creating, hosting and delivering an event listed on the Platform.
- **Payment Provider** means an authorised third-party payment service used by Infogaytion to process ticket payments.
- **Ticket** means the entitlement to attend an event, evidenced by a QR code issued through the Platform (including free RSVP entitlements).
## 2. About Infogaytion Tickets
Infogaytion Tickets is a South African marketplace ticketing platform. Through the Platform, approved Organisers can sell paid tickets, accept free RSVP registrations, and admit attendees using QR-coded tickets.
Infogaytion is not the organiser of third-party events unless expressly stated. The Platform is a technology service that enables ticketing and admissions between Organisers and buyers.
## 3. Eligibility
To purchase a ticket or complete a registration you must:
1. Have the legal capacity to enter into a binding contract;
2. Provide accurate and current information when booking, including a valid email address; and
3. Comply with any event-specific eligibility requirements (for example age restrictions, venue conditions or capacity limits) set by the Organiser.
It is your responsibility to confirm that you meet any event-specific requirements before completing your booking.
## 4. Purchasing Tickets
4.1 Ticket prices, quantities available, ticket types and event details are set by the Organiser.
4.2 When you buy a ticket you enter into two related contracts:
- A contract with the **Organiser** for attendance at the event; and
- A contract with **Infogaytion** for use of the Platform, including the issuing and management of your ticket.
4.3 A booking is only confirmed once payment has been successfully authorised by the Payment Provider and you have received a confirmation email from Infogaytion Tickets.
4.4 If a payment fails, is reversed, or cannot be verified, the corresponding ticket will not be issued or may be cancelled.
4.5 It is your responsibility to check ticket details (event, date, ticket type and quantity) before completing your purchase.
4.6 **Choose Your Contribution.** Some events may offer a "Choose Your Contribution" pricing model. Where this model is available, the Organiser sets a minimum contribution and may also provide a suggested contribution amount. Buyers choose the amount they wish to contribute using the checkout slider. The selected contribution becomes part of the purchase and is subject to these Terms and the Refund Policy.
## 5. Free Registrations (RSVPs)
5.1 Some events are offered as free RSVPs. A free RSVP is a registration that reserves a place at the event without a payment.
5.2 Free RSVPs are subject to the Organiser's capacity, admission rules and any conditions set out on the event listing.
5.3 A free RSVP does not create a payment obligation and no refund is applicable.
5.4 Organisers may cancel or withdraw a free RSVP if the event is cancelled, oversubscribed, or if the Organiser reasonably believes the registration is fraudulent or breaches these Terms.
## 6. Ticket Ownership and Use
6.1 A ticket is a personal, revocable entitlement to attend an event. It is not a security, a currency, or a store of value.
6.2 Each ticket is issued for the specific event, ticket type and buyer identified at the time of booking.
6.3 Infogaytion Tickets does not currently support ticket resale or peer-to-peer ticket transfers. Any attempt to sell, auction, or transfer a ticket outside the Platform is at your own risk and may result in the ticket being invalidated.
6.4 You are responsible for keeping your ticket and QR code confidential. Anyone in possession of your QR code may be admitted in your place.
## 7. Ticket Validity
7.1 A ticket is valid only for the event, date, time and ticket type shown on the ticket.
7.2 A ticket is invalid if it:
1. Has already been scanned in and admitted;
2. Has been refunded, voided or cancelled;
3. Relates to an event that has been cancelled or rescheduled and not honoured for the new date; or
4. Has been obtained fraudulently, duplicated, or altered.
7.3 Infogaytion or the Organiser may refuse admission to any ticket that appears invalid, and may reasonably investigate before allowing entry.
## 8. QR Codes and Admission
8.1 Each ticket is issued with a unique QR code. The QR code is the primary means of admission.
8.2 At the event, staff acting for the Organiser will scan your QR code. On the first successful scan the ticket is marked as admitted, and further scans of the same code will be rejected.
8.3 You should be prepared to present:
- Your QR code (on screen or as a printed PDF); and
- A valid form of identification if the Organiser requires it (for example for age-restricted events).
8.4 The Organiser is responsible for admission decisions at the venue, including rejecting entry where the ticket cannot be verified or where their event conditions have not been met.
## 9. Lost or Undelivered Tickets
If you have successfully completed a booking but have not received your confirmation email or ticket, please contact us at **support@infogaytion.com**. We will make reasonable efforts to help you access your ticket or resend your confirmation.
## 10. Attendee Responsibilities
10.1 You agree that when attending an event you will:
1. Comply with the Organiser's rules, venue rules, and all applicable laws;
2. Respect other attendees, staff and community members;
3. Follow reasonable instructions from Organiser staff, venue staff and security;
4. Not engage in any conduct that endangers, harasses or discriminates against others; and
5. Provide accurate identification and ticket information when requested.
10.2 The Organiser may refuse admission or remove you from an event for breach of these responsibilities. In such cases, any refund decision is made by the Organiser in line with the Refund Policy.
## 11. Event Changes, Postponements and Cancellations
11.1 Events are delivered by the Organiser, not by Infogaytion. Details such as venue, line-up, running order and start time may change.
11.2 If an event is materially changed, postponed or cancelled, the Organiser is responsible for communicating the change. Infogaytion Tickets may assist by sending notifications on the Organiser's behalf.
11.3 Where an event is cancelled or postponed, refund outcomes are handled in accordance with the **Refund Policy**.
11.4 Infogaytion may, on its own initiative or on instruction from the Organiser, cancel tickets that were issued in error, obtained fraudulently, or that relate to events that cannot proceed.
## 12. Infogaytion's Role as Ticketing Platform
12.1 Infogaytion provides the ticketing technology used to list events, sell tickets, register RSVPs, issue QR-coded tickets and admit attendees.
12.2 Infogaytion is not the organiser, promoter, host or supplier of third-party events unless expressly stated on the event listing.
12.3 Infogaytion does not endorse, verify or guarantee the accuracy of every event listing beyond the reasonable checks performed as part of listing approval.
## 13. Organiser Responsibility
13.1 The Organiser is solely responsible for:
1. Delivery of the event and the experience described in the listing;
2. Accuracy of event information, including date, venue and content;
3. Communications with attendees regarding event operations;
4. Decisions about refunds, as governed by the Refund Policy;
5. Compliance with all laws, licences and permissions applicable to the event.
13.2 Any dispute regarding the delivery, safety, quality or content of an event is between you and the Organiser. Infogaytion will assist where reasonable but is not a party to that dispute.
## 14. Payment Providers
14.1 Ticket payments are processed by authorised third-party Payment Providers. Infogaytion does not store your full card details.
14.2 By purchasing a ticket you also agree to the terms of the applicable Payment Provider for that transaction.
14.3 Refunds and chargebacks are handled in accordance with the **Refund Policy**.
## 15. Pricing and Booking Fees
15.1 Ticket prices are set by the Organiser and are displayed on the event listing before you confirm your booking.
15.2 A **Booking Fee** is added to each paid ticket and is payable by the buyer in addition to the ticket price. The Booking Fee is displayed as a separate line item during checkout.
15.3 Free RSVPs are not charged a Booking Fee.
15.4 Payment processing costs charged by the Payment Provider are deducted from the Event Organiser’s ticket proceeds.
15.5 All prices are shown in South African Rand (ZAR) unless otherwise indicated.
## 16. Refunds
16.1 Every paid-ticket event must include an Event Organiser Refund Policy. The Event Organiser is responsible for publishing that policy on the event listing.
By purchasing a ticket, you agree to the Event Organiser’s published refund policy. All refund requests must be made directly to the Event Organiser.
16.2 Where a refund is approved, Infogaytion administers the refund through the Platform in accordance with the **Infogaytion Tickets Refund Policy**.
16.3 Where required by law or where intervention is necessary to protect buyers, Event Organisers or the integrity of the Platform, Infogaytion may administer refunds independently of the Event Organiser's published refund policy. Unless required by applicable law, voluntary refunds approved by an Event Organiser apply only to the ticket value. The Infogaytion Booking Fee and any non-refundable payment processing costs are not refundable.
16.4 Where an event is cancelled, the refund process is governed by the Infogaytion Tickets Refund Policy.
16.5 Where these Terms and the Refund Policy conflict on refund matters, the Refund Policy prevails.
## 17. Prohibited Conduct
17.1 When using Infogaytion Tickets you must not:
1. Buy tickets using false, misleading or third-party details without authority;
2. Use automated tools, bots or scripts to purchase tickets or evade purchase limits;
3. Resell tickets for profit, or list tickets on unauthorised resale marketplaces;
4. Interfere with the operation, security or integrity of the Platform;
5. Attempt to reverse-engineer, copy, duplicate or forge tickets or QR codes;
6. Use the Platform in a way that infringes the rights of Infogaytion, Organisers, other buyers or third parties.
17.2 Infogaytion may suspend accounts, cancel tickets, withhold refunds and take any other reasonable action in response to prohibited conduct.
## 18. Fraud, Chargebacks and Abuse
18.1 Fraudulent bookings, chargebacks made in bad faith, and abuse of the refund process may result in:
1. Cancellation of the affected tickets;
2. Denial of admission at the event;
3. Withholding of future bookings; and
4. Reporting to relevant authorities or Payment Providers where appropriate.
18.2 Where a chargeback is initiated, Infogaytion may share transaction and ticket information with the Payment Provider and, where required, with the Organiser, in order to respond to that chargeback.
## 19. Limitation of Liability
19.1 To the maximum extent permitted by law, Infogaytion's total liability to you in connection with the Platform and any single event is limited to the amount actually paid by you for the affected ticket(s), excluding the Booking Fee where legally permitted.
19.2 Infogaytion is not liable for:
1. Loss or damage arising from the acts, omissions or event delivery of the Organiser;
2. Consequential, indirect or special damages, including loss of enjoyment, travel costs or accommodation costs;
3. Failures of Payment Providers, telecommunications, or third-party services outside Infogaytion's reasonable control.
19.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002.
## 20. Personal Information
20.1 Infogaytion processes personal information in accordance with the **Privacy Policy** and applicable law, including the Protection of Personal Information Act, 2013 (POPIA).
20.2 To fulfil a booking, Infogaytion may share necessary personal information (such as attendee name and email) with the Organiser of that event. Organisers are independently responsible for how they use that information.
## 21. Changes to These Terms
21.1 Infogaytion may update these Terms from time to time. The current version, together with its effective date and version number, will be published on the Platform.
21.2 Material changes will be communicated by reasonable means, which may include a notice on the Platform or an email to affected buyers.
21.3 Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. Bookings that were made under a previous version continue to be governed by the version in force at the time of booking, except where the change is required by law.
## 22. Governing Law and Jurisdiction
22.1 These Terms are governed by the laws of the Republic of South Africa.
22.2 The parties submit to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from these Terms, without limiting your rights under applicable consumer-protection legislation.
